Acceptance and Binding Agreement

By registering as a bidder or participating in any auction conducted by Equipment Wholesalers Auction ("Company," "we," "us," or "our"), you agree to abide by all terms and certify you are at least 18 years old.

Auction Agent Status

The Company acts solely as an agent for sellers. All auctions are conducted with reserve unless explicitly stated otherwise. Final bids are subject to seller confirmation.

Payment Terms

Payments must be made within 48 hours in U.S. dollars.
Buyer's Premium:
- Online Timed: 8% (max $750/item)
- Live Webcast: 5% (max $750/item)
Accepted: online payment, checks, cash, credit card (3% fee), bank wire.

Sales Tax

Applied per state laws. Tax exemption certificates must be submitted at registration. International buyers must contact the office.

User Accounts

Maintain accurate info, secure passwords, and comply with account rules. Accounts remain the property of the Company.

Inspection and Condition

All items are sold "AS-IS, WHERE-IS". Buyers must inspect items and accept them in current condition.

Timed Online Auctions

Lots close incrementally with a 3-minute bid extension. Buyers are responsible for transport and costs after winning bids.

Removal and Abandonment

Items must be removed within 10 business days. Abandonment may lead to resale with a 25% admin fee deduction.

Disputes and Defaults

Bidder disputes are resolved at the auctioneer’s discretion. Non-payment may result in legal and financial consequences.

Internet and Technology Risks

The Company is not liable for missed bids due to service issues.

Injury and Damage

Bidders are responsible for injuries or damage caused on-site and agree to hold the Company harmless.

Indemnification

Buyers agree to indemnify the Company for losses due to misuse, legal violations, or unauthorized account access.

Limitation of Liability

The Company’s liability is capped at $100 or the amount paid for services, whichever is greater.

Security and Privacy

We implement reasonable measures to protect user data but cannot guarantee absolute security.

Prohibited Activities

Includes reverse engineering, bot bidding, collusion, or sharing credentials.

Titled Vehicles

$60 documentation fee applies. Sales tax is calculated on full purchase amount including premiums.

Modifications and Governing Law

These terms may change without notice and are governed by the laws of [STATE].
